Legal Notice for Visability Programs

Fiduciavos T/A Janette Collins Business Growth (Operating under the names: Visability Jumpstart, Visability Accelerator, and Visability Mastery)

I. General Information

The content provided through Visability Jumpstart, Visability Accelerator, and Visability Mastery or any other programmes (collectively referred to as “the Programmes”) is delivered for consulting, coaching and research on marketing matters. While the programs are designed to provide insight and guidance, participants are solely responsible for ensuring they comply with the content laws and regulations applicable in their own country. The information provided herein is for educational and informational purposes only and does not constitute professional legal, financial, or marketing advice.

II. Purpose, Scope, and Proprietary Methodologies

The Programmes are designed to equip participants with research-based strategies and innovative techniques for business growth, client attraction, and marketing success. In this context, “proprietary methodologies” refers to the unique techniques, processes, and systems developed by the Company based on its research and consulting experience. These constitute trade secrets and are considered intellectual property. Unauthorised use, reproduction, or disclosure of these methods is strictly prohibited.

III. Intellectual Property

All content, including but not limited to written materials, digital assets, instructional methods, and supplementary resources, provided in the Programs is the exclusive property of Fiduciavos T/A Janette Collins Business Growth. Participants are granted a limited, non-transferable license to use these materials solely for their personal, non-commercial development. Any reproduction, redistribution, or commercial use without the express written consent of the Company is prohibited.

IV. Refunds, Cancellations, and Limitations of Liability

• Change of Mind Refund: Participants may request a full refund within 14 days of enrollment for any reason, without any stipulations or conditions.
• Results Guarantee: The Company provides a full refund guarantee if, after one year of participation in the Programs, the participant does not achieve the documented results. To qualify for this guarantee, the participant must have:
  • Attended all scheduled meetings.
  • Fully engaged with and completed all program activities.
  • Continuous progression
  • Consistently tracking progress using the shared tracker provided by the Company.
• Failure to meet these conditions will render the guarantee inapplicable.
• Limitation of Liability: The Company provides all materials and services “as is” without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. In no event shall the Company be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or related to the use—or inability to use—the Programs. Participants acknowledge that results may vary based on individual effort, goals, and actions.

V. Data Protection and Privacy

The Company is committed to protecting the personal data of its participants. All personal information collected is stored securely and used exclusively for communications directly related to the Programs and for ongoing marketing purposes. Participants have the option to unsubscribe from marketing communications at any time. The Company complies with all applicable data protection laws and regulations.

VI. Governing Law and Jurisdiction

This Legal Notice and the Programs are governed by and construed in accordance with the laws of England and Wales. Any disputes arising in relation to these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

VII. Force Majeure Clause

Neither party shall be liable for any delay or failure to perform its obligations under this Legal Notice if such delay or failure is due to causes beyond its reasonable control, including but not limited to natural disasters, pandemics, war, acts of terrorism, labor disputes, government actions, or other unforeseen events ("Force Majeure Events"). In the event of a Force Majeure Event, the affected party shall promptly notify the other party and make reasonable efforts to resume performance as soon as possible.

VIII. Indemnification Clause

Participants agree to indemnify, defend, and hold harmless Fiduciavos T/A Janette Collins Business Growth and its affiliates, officers, agents, and employees from and against any and all claims, damages, liabilities, losses, or expenses (including reasonable legal fees) arising out of or in connection with their use of the Program materials, the breach of these terms, or any misuse of the information provided.

IX. Severability Clause

If any provision of this Legal Notice is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from this agreement and the remaining provisions shall continue in full force and effect.

X. Non-Waiver Clause

The failure of either party to enforce any term or condition of this Legal Notice shall not be construed as a waiver of that term or any other term, or of the right to enforce such term at any time in the future.

XI. Confidentiality Clause

Participants acknowledge that during the course of the Programmes, they may receive confidential and proprietary information regarding the Company’s methodologies, trade secrets, and other sensitive material. Participants agree to maintain the confidentiality of such information and not to disclose it to any third party without prior written consent from the Company. This obligation shall survive the termination of participation in the Programs.

XII. Modifications

The Company reserves the right to update or modify this Legal Notice at any time without prior notice. Continued participation in the Programs constitutes acceptance of any modifications or updates to these terms.
